EDF & Export Compliance
From 1 October 2026, RBI's new FEMA (Foreign Exchange Management Act) export framework replaced the Softex form with the Export Declaration Form (EDF). Software exports can be certified by your Authorised Dealer bank or by STPI (Software Technology Parks of India).
The flow
- India entity invoices the parent
- Remittance arrives with a software purpose code
- Declaration certified by STPI or the bank
- FIRC / e-BRC kept as export evidence
- GST (goods and services tax) refund of unutilised credit supported by that evidence
Included in the monthly fee, once registered
- Monthly EDF filing
- Correct purpose-code classification of each remittance
- Periodic reports required under the registration
- FIRC / e-BRC collection
- Reconciliation of remittances to declarations
Why we recommend Non-STPI registration
- Regulations permit bank certification, but certified declarations reduce refund risk
- Certified declarations support the e-BRC and the export evidence GST officers commonly ask for
- Registration is quoted separately
Why this matters to you
Your input GST credit is recovered only through a refund, and the refund depends on export evidence. Under FEMA, a contravention can attract a penalty of up to three times the amount involved where it is quantifiable.
